Dividend claims in Denmark will change from 2017

From 2017 claims for refund of dividend tax will be digital

Today, any claim for dividend tax withheld in Denmark, above the limit set in a double tax treaty, can be claimed via an application to SKAT (Danish tax authorities).

However, from 2017 there will be a requirement to apply for dividend tax via an IT system as pointed out by the tax authorities. The system is appeareantly not ready for publication yet, but at least the legislative basis is in place. As such, at some point in the future (most likely during 2017) the system will be unveiled and the “standard” procedure of form-based application will be rendered obsolete.

 

What to expect with the new process

We anticipate that there will a high focus on the processing for approval of these claims due to the recent incidents with mis-use of the system. We also expect that the case will not be able to be initiated without all necessary documentation, which is likely to be presented at the point in time that the application is filed. Furthermore, we assume that the system will be tied to the system that tracks dividend recipients for control. Whether or not the new process will require a NEM-Konto is too soon to tell. Finally, we anticipate that advisors will be able to be perform these actions on behalf of clients, provided that the proper (digital) authorisation is in place.

From 2017 SKAT will be able to send out information with secret information via the individual’s or company’s online tax folder. As such, it would be a convinient time to review, who has access to messages within the tax folder.
